Terms of Service

These terms govern design services provided by Marceli Kaczmarski, an independent designer trading as a sole proprietor ("I", "me"), to the person or organisation commissioning the work ("you", "the client"). By sending a deposit, approving a quote, or otherwise instructing me to begin, you accept these terms.

1. Scope of work

Every project starts with a written brief that sets out deliverables, formats, the number of concepts, the review schedule, and the fee. Only what is listed in that brief is included. Anything added later — extra concepts, new formats, additional pages, rush timelines — is quoted separately before I start on it. I will tell you in advance if a request falls outside the agreed scope; I will not silently absorb it or silently bill for it.

2. Fees and payment

Projects above €250 require a 50% deposit before work begins, with the balance due on delivery of final files. Smaller projects are invoiced in full on completion. Invoices are payable within 14 days. Prices are quoted in euros and, where applicable, exclusive of VAT. Late payment beyond 30 days may pause the project and delay any agreed delivery date. Bank transfer charges, currency conversion, and third-party costs such as licensed fonts or stock assets are yours unless the quote states otherwise.

3. Revisions

Each package includes two rounds of revisions on the selected concept. A round means one consolidated set of feedback, sent together. Further rounds, or a change of direction after a concept has been approved, are billed at my hourly rate, quoted before I proceed. Feedback should be specific and in writing so that nothing is lost in translation.

4. Timelines and client input

Delivery dates assume you supply content, brand assets, and feedback within the agreed windows. If material arrives late, the schedule shifts accordingly. I will always tell you the revised date rather than quietly miss the original one.

5. Intellectual property

I own all rights in concepts, drafts, and working files until the final invoice is paid in full. On payment, full commercial rights in the approved final deliverables transfer to you, worldwide and without time limit. Rejected concepts, source sketches, and working files remain mine unless purchased separately. I retain the right to display the finished work in my portfolio and on social channels unless we agree a confidentiality period in writing before the project starts. Any third-party fonts, images, or code remain under their own licences, which you are responsible for maintaining.

6. Termination

Either of us may end a project in writing at any time. If you cancel, the deposit is non-refundable and any work completed beyond it is invoiced pro rata; you receive the files produced up to that point, licensed once paid. If I cancel for reasons other than your breach of these terms, I refund any amount covering work not yet done.

7. Liability and law

My total liability for any project is limited to the fees paid for it. I am not liable for indirect or consequential loss, including lost profit. These terms are governed by Polish law, and disputes fall to the courts with jurisdiction over my place of business.
